By subscribing to PropertyScan, you agree to these terms. Please read them carefully before claiming any territory.

Territory Rights & Exclusivity

PropertyScan operates on an exclusive territory model. When you claim a city or region, you become the sole subscriber with access to that territory's motivated seller data. Territory rights are transferable and can be resold, subject to our approval.

Service Description

PropertyScan provides AI-powered analysis of public property records to identify motivated sellers. Our service includes:

Weekly automated property analysis Motivation scoring (1-10) for seller likelihood 90-day listing predictions with 73% accuracy Exclusive access to your claimed territories Tired landlord identification (40+ year ownership) Estate and trust property alerts Deferred maintenance indicators

Pricing & Billing

Subscription fees are based on the number of properties in your territory, approximately $1 per property per month. For example:

Avon, MA (2,099 properties): $2,099/month Portsmouth, NH (7,467 properties): $7,467/month

All subscriptions are billed monthly in advance. Territory pricing may be adjusted with 30 days notice.

1. Acceptance of Terms

1.1. By claiming a territory or using PropertyScan, you confirm that you are a professional real estate investor or investment firm with legitimate business purposes.

1.2. These Terms and Conditions form a legally binding agreement between you and PropertyScan.

1.3. You acknowledge that PropertyScan is designed for professional investors who understand real estate transactions and seller outreach.

2. Territory Claims & Management

2.1. Each territory can only be claimed by one subscriber at a time.

2.2. Territory claims are on a first-come, first-served basis.

2.3. You may claim multiple territories, subject to availability.

2.4. Territory rights remain active as long as your subscription is current.

2.5. If you cancel or fail to pay, your territory becomes available to other investors after a 7-day grace period.

3. User Responsibilities

3.1. You agree to use PropertyScan data for legitimate real estate investment purposes only.

3.2. You must comply with all applicable real estate laws, fair housing regulations, and solicitation rules in your jurisdiction.

3.3. You are responsible for your own due diligence on any properties or opportunities identified through our platform.

4. Prohibited Uses

4.1. You may not share, resell, or provide access to your territory data to any third party.

4.2. You may not use automated scripts or bots to access the platform beyond normal usage.

4.3. You may not attempt to circumvent territory exclusivity or access data from unclaimed territories.

4.4. You may not use PropertyScan data for harassment, spam, or any unlawful solicitation.

5. Data Accuracy & Intelligence

5.1. PropertyScan provides motivation scores and predictions based on AI analysis of public records.

5.2. We maintain 92% data quality and 73% accuracy on 90-day predictions based on historical performance.

5.3. You acknowledge that all scores and predictions are estimates and not guarantees of seller behavior.

5.4. PropertyScan is not responsible for investment decisions made based on our data.

6. Intellectual Property

6.1. All AI algorithms, motivation scoring systems, and proprietary analysis methods are the intellectual property of PropertyScan.

6.2. You receive a limited license to use the data for your investment activities in your claimed territories only.

6.3. The exclusive territory model and associated business processes are proprietary to PropertyScan.

7. Limitation of Liability

7.1. PropertyScan is provided "as is" without warranties regarding deal success or seller motivation accuracy.

7.2. Our maximum liability is limited to the amount you paid for the service in the preceding month.

7.3. We are not liable for any indirect, incidental, or consequential damages from your use of PropertyScan.

7.4. You acknowledge that real estate investment carries inherent risks that are your sole responsibility.

8. Territory Transfers

8.1. Territory rights may be transferred to another qualified investor with PropertyScan's prior written approval.

8.2. Transfer requests must include the proposed new owner's investment credentials and intended use.

8.3. PropertyScan reserves the right to deny transfers that don't meet our professional investor criteria.

8.4. A transfer fee of 10% of the monthly subscription may apply.

9. Termination

9.1. Either party may terminate the subscription with 30 days written notice.

9.2. We may immediately terminate access for violations of these terms or fraudulent activity.

9.3. Upon termination, your territory becomes available to other investors after a 7-day grace period.

9.4. No refunds are provided for partial months or unused services.

10. Performance Metrics

10.1. PropertyScan maintains the following service standards:

11. Dispute Resolution

11.1. Any disputes shall be resolved through binding arbitration in accordance with commercial arbitration rules.

11.2. The arbitration shall be conducted in English via online proceedings to minimize costs.

11.3. Each party bears their own costs unless the arbitrator determines otherwise.

12. Changes to Terms

12.1. We may update these Terms with 30 days notice for material changes.

12.2. Continued use after changes constitutes acceptance of new terms.

12.3. If you disagree with changes, you may terminate your subscription within the notice period.

13. Governing Law

13.1. These terms are governed by the laws of Delaware, United States.

13.2. You consent to the exclusive jurisdiction of Delaware courts for any disputes not subject to arbitration.
